Lawsuit funding after a low settlement offer

What to consider when an insurer makes a low offer and the plaintiff is thinking about settlement funding.

Settlement pressure

Why low offers create pressure

A low settlement offer can make plaintiffs feel trapped: accept less than the case may be worth or wait longer while bills keep coming. Funding may be considered as a bridge, but it should be reviewed carefully.

The attorney may need to explain why the offer is low, whether negotiations are ongoing, and whether trial, mediation, or further treatment could change value.

How reviewers look at the file

A provider may consider the current offer, policy limits, liability, medical records, liens, prior funding, and the attorney’s view of settlement range. A low offer can be useful information, but it is not the same as final case value.

If the offer is low because liability or damages are weak, funding may be limited or declined. If it is a negotiation tactic in a stronger case, review may be different.

Payoff and negotiation timing

Applicants should compare the advance amount to expected settlement timing. If negotiations take months, charges may grow. If the case later settles close to the low offer, net recovery may be tight.

Ask for payoff examples and ask your attorney whether funding could affect negotiation decisions.

It shows there may be a claim under negotiation, but it does not prove final value.

Should funding replace settlement advice?

No. Settlement decisions should be discussed with your attorney.
